Terms and Conditions
The terms that apply when you use our website and services.
These Terms and Conditions govern your use of the website hotairl.site and any engagement with Hot Air Balloon Media Ltd. By using this website, you agree to these terms.
1. About us
This website is operated by Hot Air Balloon Media Ltd, registered in England & Wales, with its address at 86-90 Paul Street, London, England, EC2A 4NE, United Kingdom. Contact [email protected] or +48 884 957 879.
2. Use of the website
You agree to use this website lawfully and not to misuse it. All content is owned by or licensed to us and may not be reproduced without permission.
3. Information provided
Information on this website is provided for general guidance and does not constitute a binding offer or professional advice. Any proposal or quotation is subject to a written agreement.
3a. What the name does not mean
“Hot Air Balloon” is part of our registered company name and is not a description of our services. We do not operate hot air balloons or any aircraft, we do not sell or arrange balloon flights, pleasure flights, passenger flights or any other air transport, and we are not an air operator. Carrying passengers for reward by air is a licensed activity and is not something we hold ourselves out as doing. Our registered activities are motion picture production and video production.
3b. Productions, usage and licensing
Scope, deliverables, schedule and fees are agreed in writing before a production begins, and changes requested afterwards are quoted separately. The agreed scope records what is being made, its duration, the media and territories in which it may be used and for how long, because those determine both the price and the licensing of music, archive footage, contributors and performers. Rights in a commissioned production, and any licence to use it, pass as set out in the production agreement, normally on payment in full; third-party material, including music and archive, is supplied under its own licence terms and for the usage specified, and using it beyond that usage is the client’s responsibility.
We are not an entertainment or theatrical agency, a casting agency or an employment agency or employment business, we do not represent performers and we never charge an individual a fee for finding them work. Where a production requires a permission or authorisation - a filming permit or location consent, an operational authorisation from the Civil Aviation Authority for unmanned aircraft, a local authority licence for a child performer with an approved chaperone, or music and archive clearances - that permission must be in place before filming, and we will say so and either arrange it properly or tell you who must. The client is responsible for the accuracy of information and materials supplied to us, for consents from people appearing in a production where it provides them, and for its own obligations as data controller. Nothing on this website is advice for your particular situation.
4. Liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud. Subject to that, our liability in connection with this website is limited to the fullest extent permitted by law.
5. Privacy
We process personal data in accordance with our Privacy Policy.
6. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
7. Changes
We may update these Terms from time to time. The version published at the time of your visit applies.
